Terms of use

All use of the My Sailing Coach website is subject to these terms of use.

Period of contract

When you sign up as a member of My Sailing Coach you agree to be a member for a minimum period of one year and to make twelve monthly payments of the amount specified during the sign up process. The payments will be taken from the credit card detailed under "Your profile" in the members' section of the website, and you agree to ensure that these details are correct and up-to-date.

Copyrights

The My Sailing Coach website and the email messages you receive through My Sailing Coach contain copyrighted material. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material. My Sailing Coach owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way exploit the content available on or through the My Sailing Coach site, except as otherwise expressly permitted under copyright law or with the express permission of My Sailing Coach.

Disclaimer

My Sailing Coach requires that you consult with your physician before following any training instructions you receive through My Sailing Coach or participating in any event announced on the My Sailing Coach website. My Sailing Coach is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition. My Sailing Coach is not a prescription system and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. You should understand that when participating in any exercise or exercise program, there is the possibility of physical injury and or death.

You should never disregard medical advice or delay in seeking it because of something you have read on the My Sailing Coach website. My Sailing Coach is not responsible for any health problems that may result from training programs, products, or events you learn about through My Sailing Coach. If you engage in any exercise programme you receive through My Sailing Coach, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release and discharge My Sailing Coach from any and all claims or causes of action, known or unknown, arising out of My Sailing Coach's negligence. You agree to indemnify and hold harmless My Sailing Coach for any loss, liability, claim, damage, and expenses (including reasonable solicitors' fees) arising from or in connection with your use of the information or services you receive through My Sailing Coach.

PLEASE NOTE: Not all exercises are suitable for everyone. Before you begin any training instructions you receive through My Sailing Coach or participating in any event announced on the My Sailing Coach website, you should have permission from your physician to participate in vigorous exercise. If you feel discomfort or pain, do not continue. The instructions and advice presented are in no way intended as a substitute for medical counseling.

The information and services available on or through the My Sailing Coach website and in email messages sent to My Sailing Coach members come from a variety of sources. We do not actively monitor the content of the My Sailing Coach website features, newsletters, e-mail messages, or other material available through My Sailing Coach. Therefore, while we strive to bring you only the most helpful and accurate information, we cannot verify, endorse or vouch for the information, services or recommendations available through the My Sailing Coach website. My Sailing Coach is not responsible for the accuracy, reliability, effectiveness, or correct use of information you receive through the My Sailing Coach website, or for any health problems that may result from training programs, products, or events you learn about through My Sailing Coach. My Sailing Coach does not certify content or endorse any information supplied by other companies for our website.

Your use of the Message Centre or Forum available on our site is at your own risk. You are responsible for any information you disclose in the Message Centre or Forums and we cannot be held responsible or liable for the consequences of any use of the Message Centre or Forum.

Member responsibility

We assume members of My Sailing Coach will act responsibly and use the tools provided by My Sailing Coach in a law-abiding manner. If My Sailing Coach determines that any member is not using the system provided by My Sailing Coach responsibly, we can censor, edit or block their transmissions or use of the My Sailing Coach system.

Limitation of liability

My Sailing Coach and our affiliates and sponsors, are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to My Sailing Coach's website, our website related services and/or content, or information contained within the website. Your sole remedy for dissatisfaction with the My Sailing Coach website and/or our website related services is to stop using the My Sailing Coach website and/or those services.

Indemnity

You agree to defend, indemnify, and hold My Sailing Coach, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of the terms and conditions of this Member Agreement.

Security

All transfers of credit card information or personal details are protected by the Secure Sockets Layer protocol, using a 128bit key. In addition, sensitive information is also stored in encrypted form.

Cancellations and refunds

If you wish to cancel your membership of My Sailing Coach after the minimum period, please contact us at info@mysailingcoach.com at least seven days before your next payment is due. No refunds will be made unless an error has been made.

General

My Sailing Coach, in its sole discretion, may revoke the membership of those who violate its guidelines or this Membership Agreement. This Membership Agreement shall be governed by the laws of the United Kingdom without regard to its conflict of law provisions. Any action brought in connection with the Membership Agreement shall be filed within one year of the date of the alleged injury, regardless of any statute of limitations, in a court located in the United Kingdom.

My Sailing Coach is a trading name of My Sailing Coach Limited.
